Acceptance of Terms & Disclaimer

By registering with Pure Dance, you agree to comply with and be bound by the following terms and conditions & disclaimer. Please review them carefully. If you do not agree to these terms, you should not register a student with Pure Dance or use this site.

User Information

You agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account and password.

Privacy Policy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and disclose your personal information. By registering, you consent to our collection, use, and disclosure practices, and other activities as described in our Privacy Policy.

User Conduct

You agree not to use the platform for any unlawful or prohibited activities. You also agree not to interfere with the security, functionality, or proper working of the platform. This includes, but is not limited to, uploading or sharing harmful or malicious content, spamming, and unauthorized access attempts.

Intellectual Property

All content on this platform, including but not limited to text, graphics, logos, and software, is the property of Pure Dance or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. Unauthorized use of such content is prohibited.

Modifications to Service

We reserve the right to modify or discontinue the platform, temporarily or permanently, with or without notice to you. You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuance of the platform.

Termination

We reserve the right to terminate or suspend your account and access to the platform at our sole discretion, without notice and liability, for conduct that we believe violates these terms or is harmful to other users of the platform, us, or third parties, or for any other reason.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which the platform owner operates. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for the resolution of any disputes.

Fees and Payments

After corresponding with the Studio via email or WhatsApp and registering, parents/ students are responsible for all payments of their accounts and must acquaint themselves with the Terms and Conditions and General Rules prior to the student attending their first class.

non-refundable, once-off registration fee will be required for all new students, and a re-registration fee will be required every year for returning students, which is subject to a yearly increase at Management’s discretion. New registrations include a Studio jacket. However, they are subject to price changes.

The year is divided into 4 (four) terms, as per the Gauteng Government School Terms. Should you wish to take advantage of the discount when paying per term this must be paid in advance at the beginning of each term and communicated as such failing to do so, your account will be changed to the monthly cycle.

All monthly fees must be paid in advance by the 1st of each month.
 
Fees do not include exam and competition registration and entry fees. Pure Dance class fees are strictly payable in advance – you will need to pay before a class is conducted. If you do not abide by this, classes will be cancelled and you will still be liable for outstanding class fees. Invoices for the next month will be sent out at month end.
In the event where the class fees are not paid on time, an email/statement will be sent as a reminder to pay the invoiced bill. Should the person responsible for paying the bill still not settle the account after the email, the student will no longer be allowed to attend class and the account holder will be held responsible for the outstanding fees. A penalty fee of 15% will also be charged. Prices are subject to change as per the industry standard adjustments. Invoices for the next month will be sent out at month end.
 
We reserve the right to refuse to teach a student/child (or children) should the account be in arrears.
Accounts more than two months late will be handed over for collection.
 
Siblings and parents may receive a discount of 15% to 35% on class fees each month depending on the amount of family members joining the studio.

There will be no refunds for any classes paid.
All Costumes rented from Pure Dance Studio must be returned in good condition after each performance. Failure to do so will result in a penalty fee equal to 90% of the value of the costume.
Costumes are for the students/parents account and need to be paid in advance to the dance shop or dressmaker.
Please mark competition payments and costume payments clearly to avoid any confusion. (Unless you receive an invoice inclusive of both).
 

Please note that paying fees for January and December is non negotiable. 

Contract Termination

If you wish to terminate this agreement – one full calendar month’s written notice is required for Private lessons. Class Agreements requires one full month’s or term’s written notice via email or Whatsapp.
Should you be stopping at the end of the year notice must be given by the first of November. If notice is only given in by the first of December then January monthly fee will need to be paid.
 
If your child leaves the studio all trophies need to be returned immediately.
 

NO solo’s or choreography done and choreographed at the studio may be performed elsewhere when the student leaves the studio.

Liability

Pure Dance Studio does not accept responsibility, direct or indirect, and will not be held liable for and not limited to any accident or death, injuries, illness, damage and/or losses suffered by you and/or the student on the premises during dance lessons, rehearsals, performances, functions, outings and tours and you hereby agree to indemnify and hold harmless Pure Dance Studios and its employees and/or staff in the event of any such occurrences. 

 

We do not accept liability for any injuries, losses or damage however caused whilst on the Studio property or arising during lessons being taught by teachers of Pure Dance Studio, this includes guest teachers.

Pure Dance will not be responsible for students outside of class times. We highly encourage parents or guardians to walk their children in and out of the studio.  
No children should leave the studio without a parent or guardian. 
Students should not wait outside! 
We are very sensitive to our student’s safety however, we are not responsible for students before or after their class time. 
We will not be held responsible for your child/children while waiting before or after class. 
We are not an after-care center, please fetch as soon as possible after classes. Use of the waiting area is at your own risk.

Communication

There will be no messages answered after 6pm or before 9am unless there is communicated otherwise. Please Contact Pure Dance on 073 189 9049 as this is a work number.

Please make sure that lesson changes have been discussed and communicated to management.
 
Any videos that are shared on groups are purely for practice purposes and are not to be shared onto any social media platform unless it is asked that you please share the video for advertising purposes.
 
No verbal undertakings by any person employed by the Studio will be binding on the Studio unless done in writing to Management.

Competitions, Exams and Showcases

Pure Dance Studio will hold within its sole discretion the final say as to the suitability of a student to be entered for and for which examinations, competitions and/or shows/concerts and may, at its sole and exclusive discretion, withdraw or hold back from any such specified events, any student who in the opinion of Pure Dance Studio, appears to be inadequately prepared due to poor attendance and/or performance.

In the case where the student has been absent repeatedly from a class before the event, he/she will no longer be allowed to take part in the competition, showcase events or exam.
Fees for Exams, Festivals, dance shows, and extra lessons must be paid in full, 6 weeks prior to the occasion; the teachers will keep you notified of the activities.
 
Under no circumstances, may the choreography of the routine be changed by either the student, parent or guardian. If this matter occurs, the student will no longer be allowed to enter competitions under the studio’s name.
All group, duet, trio, quartet, quintet trophies will be kept at the studio and may NOT be kept by any of the pupils. If your child leaves the studio all trophies need to be returned immediately.

Lesson Policy

It is compulsory for Competitive dancers to attend exam classes and do exam for the styles they compete in. It will not be compulsory for recreational dancers to do exam, but they will not be allowed to compete in any competitions as exam classes and exam is compulsory for competitive dancers.
Private Lessons are to be cancelled 24 hours in advance.  If the lesson is not cancelled within this time frame it will be forfeited and not rescheduled. Unforeseen circumstances such as family and personal emergencies are exempt from this rule, after undergoing a review from Studio Management.

NO spectators ARE ALLOWED TO SIT IN AT ANY OF THE CLASSES. The rule is there to minimize lesson disruptions and allows the students to focus on their class. Family members are invited to come and observe the student’s progress by sitting in on the selected parent viewing day which will be in the last week of the month. The studio will communicate dates to parents. No more than 2 family members is allowed in.
It is compulsory that you reserve yourself for every class you attend.
If due to, medical reasons or injuries the subscription will be placed on hold, but not the payments,
Full Payment for the subscription to be made in advance.
If a class is cancelled, it is the student’s obligation to catch up the lesson per private lesson.
Failure to attend the classes as stipulated above may result in forfeiting those classes.
Packages will only be placed on hold if a serious injury has occurred and accompanied by a doctor or physiotherapist letter.
Schedules and operating times could change due to attendance and teacher schedules, etc. Notice will be given via Whatsapp. The Studio reserves the right to provide a substitute instructor if the regularly scheduled instructor is ill or otherwise unable to teach classes.
Private Lessons work as follows:
Catch ups must be done within a month after the cancelled class.
Catch-up classes cannot be deducted from next month’s payment.
No late coming permitted for dance class, no one will be allowed into class 10 minutes into the lesson.
No refund will be given for classes missed.
No classes will be held on public holidays or Sundays – applicable to all dance lessons.
Pure Dance Studio agrees to give the course of dance instruction in accordance with Pure Dance Studio’s method of instruction, which is affiliated to the applicable dance style bodies.
Students must please vacate the dance floor as soon as classes end, to accommodate the next class.
Correct dance attire must be worn for each lesson. 
This includes hair neat and tidy.

Online Lesson Policy

Ensure to log on a few minutes before the class time and wait to be admitted in.
Find a space that is quiet and at least 2 x 2m in size.
Be respectful at all times.
Ensure you have your camera switched on throughout the entire class so the instructor can see you.
Stay on mute and click the “raise hand” button if you have any questions.
Stay focused and on task while your instructor is busy with class.

POPI Act

a new Act called POPI (Protection of Personal Information) has come into effect in South Africa as of 1 July 2021. Although we have always taken strict and secure measures to protect your personal information, we want to advise you of our compliance with the Act. Please see our updated Privacy Policy relating to the protection of your personal information:

Privacy Policy:

This privacy note articulates the parameters in the collection, processing, storage, distribution, and destruction of personal information Pure Dance referred to as aligned to the POPI Act, No 4 of 2013. It provides what must and must not be done with your collected personal information that we become privy to. This privacy note must be adhered to by all key individuals, including Teachers /Personnel, parents/guardians and service providers where applicable.
 

Our Commitment:

Not to use personal information for any other purpose than in connection with your expression,
To make it easy for you to approach us if you have any concerns or questions relating to the holding of personal information,
To not provide personal information to others save where legally required to do so, otherwise specified in this Privacy Notice or otherwise to assist us with our tasks.
 

How your information is collected:

Verbally (Telephonic or face to face)
Completion of paper documents or of electronic means such as google forms, Whatsapp or email.
 
What personal information will Pure Dance collect from you:
No personally identifiable data is retained any longer than 60 months following the ending of a Memorandum of Agreement, and the data will only be processed in a statistical manner. 
 
We will ensure that appropriate technical and organizational measures are in place such that this data is shared and stored securely. 
 

Pure Dance will not provide personal information for use by anyone else unless:

We have your specific consent; 
It is necessary for health and safety reasons;
It is necessary to comply with child protection policies and procedures or otherwise in relation to child welfare and child protection; 
It is necessary for complying with any other obligations or duties Pure Dance has under the law.
 

Pure Dance will use your personal information for the following purposes:

To respond to enquiries and applications and to fulfil contractual obligations: 
In the unlikely event of concerns about your welfare, child welfare or child protection issues, relevant information may be provided to local or public authorities. 
 
To comply with legal duties Again, in very rare circumstances, Pure Dance may be required by child welfare or child protection issues to provide information to local or public authorities, including the police. 
 
If you have any concerns about Pure Dance processing personal information for legitimate interest purposes, please contact us. 
 
When you consent There may be occasions when Pure Dance may wish to use personal information but will not do so without your specific consent. 
Where consent is requested, it will be sought separately. If consent is given, it can be withdrawn at any time by notifying Pure Dance in writing, Whastapp or by email. This will also apply to all parents/guardians or students who are enrolled in Pure Dance.
 

Your rights concerning the information held about you:

Access – the right to make what is known as a Subject Access Request for a copy of the personal information which we hold about you. If you make such a request, we are required, in most circumstances, to provide a copy of the personal information without charge and within 30 days.

Correction — it is important that you keep us up to date with any changes to the personal information provided. Subject to that, you have the right to ask us to correct or complete any inaccurate or incomplete data held about you. Evidence may be required of the new information provided.

Erasure — you are entitled to ask us to delete or remove personal information held where there is no good reason for Pure Dance to continue to keep it. It may not always be possible to comply with your request due to ongoing obligations related to personal information. However, where this is the case, you will be informed and told why it is not possible to comply with the request.

Objection to processing — you may object to Pure Dance processing personal information. There are some circumstances in which it will not be possible to comply with your request, for example, if it is necessary to process the information in connection with Pure Dance obligations, which have been explained to you in this document. If you object to Pure Dance processing information that has been processed for Pure Dance legitimate interests, we won’t continue to process it for that purpose without your agreement.

Restriction of processing — you may ask Pure Dance to suspend the processing of personal information in the following situations: 

If you want the data accuracy to be establishedWhere the use of the personal information is unlawful, but you do not want it to be erasedWhere you need the data to be held by Pure Dance in case you need it to establish, exercise, or defend legal claims; or

 

Keeping your information safe:

Pure Dance has put in place appropriate security measures to prevent personal information from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. 
 
Access to personal information is limited to those employees and contractors who need to know the personal information in connection with the purposes conveyed to you and will only be processed 
 
(i) upon instructions from Pure Dance and
(ii) in accordance with procedures put in place to deal with any suspected breach of the requirements under the POPIA. 
You and/or the POPI Information Officer referred to below will be notified of any potentially significant breach.
 

If you want to complain:

Violations of this Policy and the POPI Act will be dealt with by Pure Dance. Then, if it is not resolved within 30 days of reporting the breach, the parent/guardian has the right to forward the violation to the Information Regulator. A data subject who has a complaint against us, either concerning its conduct or this Policy, may refer a complaint to the Information Regulator in terms of sections 63(3) and 74 of POPIA.  
 
You have the right to complain to the Information Regulator. You can do this by contacting the Information Regulator’s Office directly. Full contact details, including a helpline number, can be found on the Information Regulator’s website (http://www.justice.gov.za/inforeg/)

PURE DANCE RESOLVES THE RIGHT TO ADD OR CHANGE ANY RULE AT ANY TIME WITHOUT PRIOR NOTICE. HOWEVER, WE WILL ENDEAVOUR TO INFORM THE STUDENTS OF ANY SUCH ADDITIONS/AMENDMENTS IN A TIMELY MANNER.
